These terms and conditions shall govern your use of our website www.GeoGenieapp.com and our app GeoGenie®.
The use of “we”, “our”, “us” referred to GeoGenie®, the mobile application operated by Genie App Ltd.
The GeoGenie® App is available to download from the iOS App Store or the Google Play store.
GeoGenie® is a Service Provider booking platform that uses geolocation technology to link local customers with local Service Providers.
By using our website or app, you accept these terms and conditions in full; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website, our iOS app or our Android app.
If you register with our app, submit any material to our website or app or use any of our services, we ask you to expressly agree to these terms and conditions.
You must be at least 18 years of age to use our services; by using our services or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age.
These Terms and Conditions may be updated from time to time without notice or notification.

The use of the GeoGenie® App & Website is for the sole purpose of registering as a customer or Service Provider and the searching for and booking of supported services.
GeoGenie® makes no warranty that the App or Website will operate free of errors or function at all times. GeoGenie® accept no liability for losses or damages caused by or associated with an interruption of service or error that may occur while using the GeoGenie® App or Website.
How GeoGenie® Works - Customer
Customer = Anyone or any company making a booking.
Service provider = Worker.
GeoGenie® is a smartphone only software application that connects customers with available workers to undertake jobs, services or tasks booked via the GeoGenie® platform.
GeoGenie® uses on demand and geolocation technology.
When a customer submits a booking for a worker via the GeoGenie® platform, GeoGenie® will connect suitable workers in the geographic area of the customer with the customer.
GeoGenie® will access the location services on the customers phone to determine the customers location in order to assign local Service Providers to them.
When the customer confirms the worker they want to book, the customer will pay GeoGenie® the workers first hour cost via Apple Pay, Google Wallet, Credit Card or Debit Card. Cash is not an accepted payment.
If the work exceeds the cost of the first hour fee, the worker will send the customer a quote via the GeoGenie® platform. Once the customer approves the quote, the customer will pay the balance of the quote through the GeoGenie® app payment system for the work to conclude.
To the best of GeoGenie® efforts, all information provided is intended to be accurate. It is not possible to ensure the accuracy of third parties and GeoGenie® will not be held liable for any loss or damage borne from incorrect information published on the App or Website.
GeoGenie® doesn’t accept cash payments.
When a booking is made using the GeoGenie® app, the agreed fee is pre-authorised from the customers payment method. Only when the customer marks the job as complete will the payment will be taken from the customers account.
It is the customers responsibility to provide a safe working environment for the Service Provider and provide uninhibited access to the area where the booked job is located.
GeoGenie® advise customers to request Service Providers provide proof of their accreditations before the booked work commences.
GeoGenie® accepts no liability for any loss or damage incurred by the customer when using the service. Specifically, loss or damage associated by interaction with a Service Provider you have booked.
GeoGenie® reserves the right to deactivate customer’s accounts and refuse service with no notice for an infringement of the Terms & Conditions. GeoGenie® will not be held liable for any loss or damage a customer may incur with such deactivation.
GeoGenie® takes reasonable care when recruiting Service Providers, however, you are solely responsible for taking security precautions when inviting strangers into your home or business.
Customers will not use the App or Platform for illegal activities.
Customers will treat all Service Providers with respect. GeoGenie® will not tolerate physical or verbal abuse of Service Providers. Customers found to infringe on this term will have their account deactivated.
GeoGenie® cannot guarantee a Service Provider will be available, nor can GeoGenie® guarantee a Service Provider will not cancel the booking. In this instance, not charge will be made to the customer.
Customers will not circumvent the GeoGenie® app payment platform by offering payment directly to the Service Provider.
Work carried out by Service Providers paid directly and circumventing the GeoGenie® payment platform will not covered by these terms and conditions, and GeoGenie® will not be accountable in any way grievance between the customer and Service Provider.
Circumvention of the GeoGenie® payment platform will result in the customers account being deactivated.
Worker Registration and Terms of Engagement
GeoGenie® has no registration fee, no subscription fee and no minimum term contract.
Workers set their own rates of pay. GeoGenie® does not dictate how much a worker can charge for a job.
Worker registration on GeoGenie® refers explicitly and completely to registering you or your employees with the GeoGenie® referral platform.
GeoGenie® do not employ workers directly. GeoGenie® operates as a referral platform only.
All workers remain employees of their respective company and are not employees of GeoGenie®.
Workers choose when they are available. GeoGenie® does not set minimum hours workers must be available. Availability is set entirely by the workers discretion.
Workers may work for whoever and whatever they choose. GeoGenie® has no contract with workers preventing them from working for anyone they choose.
GeoGenie® requires prospective workers to register via the GeoGenie® app.
GeoGenie® will review and decide to approve workers account applications based on GeoGenie®’s internal referencing and verification procedures.
Any refusal to approve worker applications is at the sole discretion of GeoGenie®. There is no appeals process. All decisions are final.
GeoGenie® reserves the right to cancel or suspend any account at any time and without notice for infringement of the GeoGenie® Terms and Conditions.
GeoGenie® takes a 15% + VAT from every booking made by a customer as a referral fee. Other than this, the GeoGenie® platform is free to use.
GeoGenie® will use geolocation technology when allocating on demand jobs.
Payment is sent to the workers account by the payment processer stripe.com at the time of job completion.
A worker may request by email to help@geogenieapp.com if they want to close their account.
Cancellations
Customers will receive a full refund if they cancel an on demand job within 15 minutes of booking if the Service Provider hasn’t marked their status as on route.
If the Service Provider is on route, the customer may still cancel, but receives no refund.
Cancellation of future bookings must be requested no less than 24hrs before the booking is scheduled for a full refund.
The above terms do not waive any rights a customer has under the Consumer Contracts Regulations 2013 or the Distance Selling Regulations 2000.
If a Service Provider arrives at the booked job address and is unable to contact the customer to enter the property where the job is to be carried out. The Service Provider will wait up to 15 minutes. After this time the booking will be cancelled, and the customer will be charged the full payment for the booking.
If a Service Provider cancels the job, the customer will not be charged. GeoGenie® is not responsible to the customer for loss or damage caused by the cancellation of a job by a Service Provider.
Loss or Damage
If either the customer or Service Provider feel they’ve incurred a loss, damage or injury in the course of the job completion while using the GeoGenie® platform, the parties should initially attempt to resolve the issue between themselves.
In unresolved cases of loss, damage or injury, GeoGenie® may offer a discretionary without prejudice payment to the aggrieved party to settle the matter.
If, GeoGenie® has been unable to mediate a settlement of the grievance within 28 days of the aggrieved party informing GeoGenie®, the parties agree to exclude GeoGenie® from further communication on the disputed matter and both parties agree to absolve GeoGenie® of any compensatory responsibility in the parties aggrieved matter.
The maximum liability GeoGenie® app has in any instance, is limited to the service fee we will receive for the booking of the job relating to a grievance or legal claim.
If parties disagree with any of Section 5 of the Terms & Conditions, the only remedy is to cease to use the GeoGenie® platform and services.
Complaints
Either the customer of Service Provider has the option to report a problem with a job using the in app report function.
If any provisions within are held to be illegal or unenforceable such provisions shall be severed and the remainder of these Terms and Conditions shall remain in full force and effect unless the business purpose of this Agreement is substantially frustrated thereby.
Neither party shall have the right to assign or subcontract any of its obligations or duties under this agreement without the prior written consent of the other party, which consent shall not be unreasonably withheld or delayed.
No waiver of any provision of this Agreement will be valid unless in writing and signed by the person against whom such waiver is sought to be enforced, nor will failure to enforce any right hereunder constitute a continuing waiver of the same or a waiver of any other right hereunder.
These terms and our Privacy Policy, term of website use and acceptable use policy constitute the entire agreement between you and us and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter.
You acknowledge that you have placed no reliance on any representation made but not set out expressly in these Terms of Use.
Any notice to be given under this Agreement may be given via email, regular mail, or by hand to the address provided on the Website.
Nothing herein shall create or be deemed to create any joint venture, principal-agent or partnership relationship between the parties and neither party shall hold itself out in its advertising or otherwise in any manner which would indicate or imply any such relationship with the other.
No person who is not a party to this Agreement shall acquire any rights under it or be entitled to enforce any of its terms whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
These Terms and Conditions shall be subject to the laws of England and the parties shall submit to the exclusive jurisdiction of the English courts.
